The charges against SIU mathematics professor Mingqing Xiao were upheld Tuesday by the 7th Circuit Court of Appeals.

Xiao was arrested and charged with wire fraud, making a false statement, failing to disclose his foreign bank account on his income tax returns, and failing to file a required report with the Department of the Treasury in April 2021

He was acquitted of wire fraud and making a false statement, but a jury found him guilty of filing false tax returns and failing to file a report of a foreign bank account.

Xiao appealed the ruling but it was upheld by the appeals court on Tuesday.

When he was convicted, he got no jail time but he did get probation and had to pay a fine.
