A federal judge in Chicago has thrown out a lawsuit by suburban residents who accused promoters of a new coal power plant in St. Clair County of misrepresenting construction and electricity costs.
The class-action lawsuit by ratepayers in Batavia was one of several face-offs between municipal customers and power suppliers working to recoup investments in the financially-troubled Prairie State Energy Campus. Among the owners of Prairie State is St. Louis-based coal company Peabody Energy.
The St. Louis Post-Dispatch reports the judge determined that the Indiana Municipal Power Agency and consultants named as defendants properly relied on cost projections in a deal sought by the city of Batavia.
The city of Hermann, Missouri has also sued over electricity contracts it says it agreed to because of misleading information.
