Illinois Assault Weapons Ban hearings ended

Illinois' assault weapons ban is now in the hands of federal judge Stephen McGlynn.

After spending four days in the Federal Southern District Court of Illinois the case challenging Illinois' assault weapons ban is now in the hands of federal judge Stephen McGlynn.

Jeff Williams with Capital View WSIU discussed this case with John Jackson, a visiting professor with the Paul Simon Public Policy Institute and Brendan Moore, a state of Illinois government reporter with Lee Enterprises.

While plaintiffs claim this ban violates the rights listed in the Second Amendment of the U.S. Constitution, the state says that weapons meant for military use are subject to regulation.

Jackson cited former justice Antonin Scalia when discussing the rights of the government versus the rights of the people.

"Even Justice Scalia, talking in the Bruen decision, said that there can be some state and local government rulings that the right of the government prevails over the right of the individual and that’s of course what’s at stake here." Jackson said.

Judge McGlynn is expected to make a decision regarding the case in the upcoming months.
